1. General & Disclaimer

1.1. In these Terms & Conditions (“T&Cs”), “We”, “Us”, “Our”, “Legends” means Legends Global Hospitality Australia Pty Ltd (ACN 663 289 218) who are appointed by Cricket Australia (ABN 53 006 089 130) to manage the Website (as defined below in paragraph 2.1).
1.2. This Website (as defined below in paragraph 2.1), is a channel for customers to place orders for products we have available for purchase.
1.3. While we endeavour to ensure the functionality of our Site, to the maximum extent permitted by applicable laws:
1.3.1 we in no way guarantee uninterrupted access to our Site or the security of our Site.
1.3.2 we do not guarantee the accuracy or completeness of the elements and / or information published on our Site; and
1.3.3 we disclaim liability for any damage whatsoever, including without limitation direct, indirect, incidental, special, punitive or consequential damages and / or loss of profits, business interruption or loss of data or information that may result from access to our Site and the use of all or part of the elements or information contained on our Site.
1.4. Illustrations and photos contained on our Site are sample representation of the Products advertised, and variations may occur from time to time and from store to store.
1.5. While the information contained on the Website is believed to be accurate and current, it is provided by Legends in good faith on an "as is" basis. Legends, its directors, officers or employees make no representation or warranty as to the reliability, accuracy or completeness of the information contained on the Website, and none of them accept any responsibility arising in any way (including negligence) for errors in, or omissions from, the information contained in the Website.
1.6. You may have rights under Australian Consumer Law, and these T&C’s do not exclude any rights you have under Australian Consumer Law, or any applicable state/territory legislation.
1.7. To the extent (if any) that the content of the website does not satisfy the laws of a country other than Australia, it is not directed to persons in those countries and they should not use the website.

2. Acceptance

2.1. The www.shop.cricket.com.au website and online store (collectively, the “Website”) is licensed and operated by Legends.
2.2. Access and use of the  Website is conditional upon your acceptance and compliance with the terms, conditions, notices and disclaimers set out herein (our “T&Cs”).You should read them thoroughly before using our website and online store, or any goods and services provided through our website (collectively, our “Services”). Your use of the Website constitutes your agreement to the T&Cs.
2.3. Legends reserves the right to amend the T&Cs at any time and without notice to you. We may change the T&Cs from time to time, and your continued use of the Website after any amendment becomes effective constitutes an agreement by you to abide, and be bound by, the T&Cs, as so amended. We will always publish a link to our current T&Cs from the Website homepage at www.shop.cricket.com.au.
2.4. These Terms & Conditions shall be governed by and construed in accordance with the laws of the state of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of the state of New South Wales, Australia.

3. Orders, Pricing & Availability

3.1. Prices displayed within this Website are shown in Australian dollars (AUD) and include GST where applicable. Pricing on a product detail webpage may not include delivery charges (if applicable). Please read the Shipping & Returns details contained within this website for more information regarding delivery charges.
3.2. Any Order placed by you in the manner described in this website is an offer to purchase a particular Product for the price (including the delivery and other charges and taxes) specified in this Website at the time you place your order on these Terms & Conditions. No order shall be deemed to be accepted by us until we issue an email acceptance of the order.
3.3. Legends reserves the right to accept or reject your order for any reason, including, without limitation, the unavailability of any product, an error in the price or the product description posted on this website, or an error in your order.
3.5. Prices of products and services, as well as delivery and other charges displayed on this website are current at the time of issue but may change at any time and are subject to availability. In the event of a change in price you will not be charged a higher sum than the one displayed at the time of issue without your express agreement. All pricing on our website is available online only, and is not transferable in-store, or vice versa, on occasion where pricing differs between the two.
3.6. Prices displayed on this website are inclusive of GST applied at the rate of 10%. You are responsible for any taxes, duties or other liabilities imposed by any government agency, including without limitation, any customs duty, goods and services taxes or any value added tax imposed on any product or services acquired or ordered by you from this website.

4. Delivery & Tracking

4.1. We deliver products via our website worldwide.  Please email us at support@shop.cricket.com.au to enquire about a special volume order. All parcels are shipped from Melbourne, Australia.
4.2. We endeavour to dispatch orders within two business days of you placing the order.  Shipping times are estimated at between 5-10 working days within Australia and 10-15 working days internationally, depending on the destination of the purchase.
4.3. Orders choosing Express Post are classed as a VIP order and dispatched asap after receipt of your order.  Follow the link to Australia Post's  express post delivery zones. For more urgent deliveries, email support@shop.cricket.com.au and we will help you to make it happen.
4.4. We suggest delivery direct to your home or workplace as goods are required to be signed for.  Australia Post does not leave parcels at unattended premises, all parcels will be carded and taken back to the local post office. Delivery to a street address is preferable as most post office boxes are not sufficient in size to accommodate orders and/or the goods cannot be signed for. 
4.5. In the event that our carrier is unsuccessful in delivering to you on more than one occasion, the parcel may be returned to our warehouse.  In the event that this occurs you will be liable for any additional freight charges and/or taxes incurred to resend your parcel.
4.6. Delivery lead times are estimated as accurately as possible.  Legends will not be held liable for third party delays including but not limited to carrier delays, natural weather events, peak freight periods, country’s customers (export/import) clearance requirements etc.   No compensation will be paid in the event of delivery deadlines being exceeded.
4.7. Goods delivered within Australia will be sent via express or standard delivery.  You will receive an email to confirm your goods have been shipped and parcel tracking information so you can check your parcels whereabouts.
4.8. Goods delivered internationally will be sent via Australian Post Express .  You will receive an email to confirm your goods have been shipped and parcel tracking information so you can check your parcels’ whereabouts.

5. Delivery Charges

5.1. Where applicable, freight will be charged at the following rates and will be added to your shopping cart at the time of checkout.
5.2. * Free freight offer is not applicable to Express Post or International deliveries.
5.3. Deliveries of large/bulky orders may incur additional charges.  We will contact you in such an event to discuss increased shipping costs.
5.4. Please note that each individual country has different customs and duty charges, it will be the responsibility of the receiver to pay for these charges.  Goods will not be released by the carrier until the charges have been paid in full.  It would be prudent to check with local authorities to ascertain the charges, or Google Duty Tax calculator for a particular country.   Deliveries of large/bulky orders may incur additional charges.   We will contact you in such an event to discuss increased shipping costs.

6. Payment

6.1. Payment is required at the time of purchase and placement of your order. Payment is charged/debited at the end of the complete check-out process. You will not be charged prior to the final step and can choose not to proceed at any time before payment is taken.
6.2. We accept payment via Visa, Mastercard,  and  gift vouchers that are valid for use on the Website (each a “Gift Voucher”). You must comply with the applicable T&Cs of these providers.
6.3. All International orders are charged in Australian dollars (AUD) with the exchange rate being determined at the time of the credit card authorisation. Prices listed at the time of checking out include GST, as is required by Australian law. Purchases delivered internationally are not subject to GST. Credit card payments will be processed in the name of The NRL Stores Pty Ltd.
6.4. Gift Vouchers should be treated like cash.  Lost or stolen Gift Vouchers will not be replaced or refunded.  Gift Vouchers are not redeemable for cash and cannot be exchanged.   The Gift Voucher is partially redeemable and can be used over multiple purchases.  Gift Vouchers will automatically expire 3 years (36 months) from the issue date or until no amount remain on the Gift Voucher.  Any unused amount after the expiry of the voucher will not be available for use. The Gift Voucher can only be redeemed on the www.shop.cricket.com.au website.
6.5. Only 1 Gift Voucher can be used per transaction

7. Risk and Title

7.1. Legends  will retain title to the products you order until you have made payment in full for those products, but all risk in the products will pass to you upon their delivery to or collection by a postal or courier service.
7.2. You should consider whether you need to obtain any suitable insurance.

8. Returns, Refunds and Exchange

8.1. Your complete satisfaction is important to us; if you are not satisfied with your purchase for any reason, we will happily exchange or issue a credit note to the amount of the returned items, however you must contact us within fourteen days of the receipt of your order.
8.2. Where possible, items returned for exchange should be returned in the same condition as they were sent, in the original packaging, labels intact and the item unused and unworn. Returns and exchanges must be mailed at your expense to Legends Global Hospitality Australia Pty Ltd - Orion Warehousing, 40 Archbold Road, Minchinbury, NSW 2770, Australia – Australia registered post.  We cannot accept any liability for goods lost in transit. Credit notes or exchanges will only be given on the item value; delivery charges are not refundable. An additional delivery cost may be charged for exchanged items.
8.3. Please choose your apparel and heat pressed personalisation carefully as no exchange will be offered on products that have had numbers/names pressed onto them unless they are faulty.
8.4. We are not required to provide a refund or replacement if you change your mind.  But you can choose a refund or exchange if an item has a major problem. This is when the item:

  • has a problem that would have stopped someone from buying the item if they had known about it
  • is unsafe
  • faulty goods
  • is significantly different from the sample, image, or description
  • does not do what we said it would, or what you asked for and cannot be easily fixed.
  • If the problem is not major, we will repair the item within a reasonable time. If it is not repaired in a reasonable time you can choose a refund or replacement.
  • Please keep your proof of purchase– e.g. your receipt

9. Cancellations and Loss or damaged in transit

9.1. You must contact us immediately if you wish to cancel your order.  If your order has not been dispatched, we shall gladly cancel and refund your order.
9.2. If your order has been dispatched you will be responsible for expense of its return, and all items must be returned in the same condition as when they were sent, in the original packaging, labels intact and the item unused and unworn. Upon receipt of the returned items, we shall refund your order. We reserve the right to refuse items which are not returned in a good condition and we will not refund any item that has been damaged, worn, washed or had the labels removed.
9.3. Legends uses reliable mailing services, however mishaps do occur.  All items are checked thoroughly before packaging with care. Should a package be delayed, arrive damaged or not at all, please contact us promptly by email or phone so we can discuss the issue.
9.4. Legends will not be held accountable for items that are damaged or lost during transit and no refunds or credit notes will be provided for items which are lost or damaged in transit. For this reason, we use delivery processes that are traceable.

10. Intellectual Property

10.1.  Acknowledge that the copyright in the Site, the software, design, text and graphics comprised in the Site, the selection and layout of the Site and the content and materials on the Site (together, the 'Materials') are owned by or licensed to us;
10.2. Must not modify, copy, adapt, store in a retrieval system, reproduce, upload, post, transmit, sell, distribute in any way or communicate to the public any material without our prior written consent; and must not frame or embed in another website any of the material appearing on this Site without our prior written consent.
10.3. You may store a reproduction of the content on this Site on your local computer for the sole purpose of viewing the content and materials; and print hard copies of the content and materials for the sole purpose of viewing and purchasing Products but not for any other use, including commercial use
10.4. This Site contains registered trademarks and other trademarks which are protected by law. You must not use any of the marks or trademarks appearing on the Site or our name or the names of our related bodies corporate without our prior written consent. You must not use any of the other company, Product and services marks on the Site that are owned by other third parties (including our suppliers) without obtaining the relevant third-party owner’s consent

11.1. You may be asked to input information about yourself on this Website. We take your privacy seriously, and your personal information will always be treated in accordance with our Privacy Policy.
11.2. Please read the Privacy Policy contained within this website. Our Privacy Policy sets out what information we collect, how we use it and what data we store.

12. Registration

12.1. You may complete the customer registration process through our Site before placing an order. Any personal information that you provide will be used by us in accordance with our Privacy Policy.
12.2. You may not have more than one active account, and your account is non-transferable. You may update, edit or terminate your account at any time through our Site.
12.3. If you choose to use a workplace email address for your account or to access our Site, then you are solely responsible for ensuring that you comply with the rules, policies or protocols that apply to the use of your email address and your workplace facilities.
